Introduction
Welcome to Cub Guide, a student behavior tracking and analysis platform designed to help hardworking teachers and educators guide students' behaviors more easily and effectively. These Terms of Service ("Terms") form a legally binding agreement between you (the "User," meaning teachers, school staff, or authorized school representatives) and Cub Guide ("we," "us," or "our"), operated by MacLine Solutions LLC, located in Nebraska, United States.
By accessing or using https://cubbehaviorguide.com or any related services (the "Service"), you agree to these Terms. If you are accepting on behalf of a school or district, you represent that you have authority to bind that entity. If you do not agree, please do not use the Service.
These Terms work together with our Privacy Policy, which explains how we handle data (including student information) with strong FERPA and COPPA protections.
1. Eligibility and Accounts
You must be an authorized school employee or representative to create an account. Accounts are created via school invitations or direct signup. You agree to provide accurate information and keep your login credentials secure. Notify us immediately at info@cubbehaviorguide.com of any unauthorized access. We reserve the right to suspend or terminate accounts for violations.
2. Use of the Service
The Service lets you track student behaviors, set schedules, generate reports, communicate with parents, and view progress trends – all to support positive student guidance. You agree to use it only for legitimate educational purposes, in compliance with your school's policies, FERPA, and applicable laws. Do not misuse the Service (e.g., no unauthorized data access, no commercial exploitation).
3. User Content and Student Data Ownership
Schools and users retain full ownership of all student data entered into the Service (including names, behavior ratings, notes, think sheets, and parent contacts) – this is "School Data." We process School Data solely to provide the Service, as a "school official" under FERPA with legitimate educational interest. We never sell, rent, share for advertising, or use School Data for non-educational purposes.
You grant us a limited license to use School Data as needed to operate, improve, and support the Service (e.g., generating reports). We implement strong security: encryption in transit and at rest, row-level security, role-based access, PIN hashing, and rate limiting.
4. Subscriptions and Payments
The Service offers subscription tiers (e.g., Data Collection, Professional) billed annually per teacher. Pricing is listed on our site. Payments for credit cards are processed securely via Stripe or by check payable to Cub Guide. Subscriptions auto-renew unless canceled. No refunds for partial periods unless required by law. Schools may contact us for volume pricing.
5. Termination
You or your school may cancel anytime via account settings. We may suspend or terminate access for violations, non-payment, or legal requirements. Upon termination, you can export School Data via a JSON file. We delete data per our retention policy after export or request.
6. Data Security and Breach Notification
We maintain reasonable security measures appropriate for student data. If we discover a breach of security involving Nebraska residents' personal information likely to result in unauthorized use, we will investigate promptly and in good faith. We will notify affected Nebraska residents as soon as possible without unreasonable delay (consistent with law enforcement needs) and notify the Nebraska Attorney General when required by Nebraska law (Neb. Rev. Stat. § 87-803). Schools control notifications to parents.
7. Intellectual Property
We own the Service, software, designs, and branding. You may use outputs (e.g., reports) for educational purposes. Do not copy, modify, or reverse-engineer the Service.
8. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available" without warranties. We are not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed fees paid in the prior 12 months. This applies to the fullest extent permitted by law.
9. Changes to Terms
We may update these Terms with 30 days' notice via email or in-app notification. Continued use after changes means acceptance.
10. Governing Law
These Terms are governed by the laws of the State of Nebraska, without regard to conflict of laws principles. Any disputes will be resolved in Nebraska courts.
